GoSYNQ Terms of Service

1. Agreement to Terms

By accessing or using GoSYNQ's services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Services.

GoSYNQ Ltd ("GoSYNQ", "we", "us", or "our") provides event promotion services including ticketing, content creation, landing pages, and audience management tools to event promoters and venues ("Customer", "you", or "your").

2. Services Provided

GoSYNQ provides the following services:

  • Ticketing Platform: QR code ticket generation, payment processing via Stripe, and mobile ticket scanning
  • Content Creation: Event promotional content including social media posts, captions, and video clips
  • Landing Pages: Custom event pages and smart bio links
  • Audience Management: Data collection, storage, and insights via integrations with Notion, Airtable, and other platforms
  • Giveaways & Promotions: Competition and reward campaign tools
  • Analytics: Performance tracking and reporting

3. Account Registration & Eligibility

  • You must be at least 18 years old and legally capable of entering into binding contracts
  • You must provide accurate, complete, and current information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account

4. Pricing & Payment

4.1 Subscription Fees

  • Monthly subscription fees are charged in advance and are non-refundable
  • Pricing is subject to change with 30 days' notice
  • Failure to pay may result in suspension or termination of Services

4.2 Ticketing Fees

  • GoSYNQ does not charge platform fees for ticket sales
  • Payment processing fees (Stripe: 2.5% + £0.20 per transaction) apply and are the responsibility of the ticket buyer or can be passed on as a booking fee
  • You are responsible for setting ticket prices and managing refunds in accordance with applicable law

4.3 Refunds

  • Subscription fees are non-refundable except where required by law
  • Event ticket refunds are managed by you (the promoter) according to your event's refund policy
  • GoSYNQ is not responsible for issuing refunds for tickets sold through the platform

5. Ticketing Terms

5.1 Ticket Sales

  • You are responsible for accurate event information (date, time, venue, capacity)
  • You must comply with all applicable laws regarding ticket sales and events
  • You must clearly display your refund policy to ticket buyers
  • You are responsible for managing event capacity and ticket availability

5.2 QR Code Tickets

  • Each ticket includes a unique QR code for entry verification
  • QR codes are single-use and cannot be duplicated for fraudulent entry
  • GoSYNQ provides the scanning technology but is not responsible for door management

5.3 Failed Events

  • If an event is cancelled or postponed, you are responsible for notifying attendees
  • You must handle refunds in accordance with your stated refund policy and UK consumer law
  • GoSYNQ is not liable for cancelled or postponed events

6. Content & Intellectual Property

6.1 Your Content

  • You retain all rights to content you provide (event details, images, branding)
  • By using GoSYNQ, you grant us a license to use your content to provide the Services
  • You represent that you have all necessary rights to any content you upload

6.2 GoSYNQ Content

  • Content created by GoSYNQ (graphics, captions, videos) is provided for your use in promoting your events
  • You may use this content for promotional purposes related to your events
  • You may not resell or redistribute GoSYNQ-created content to third parties

6.3 Platform & Technology

  • GoSYNQ retains all rights to the platform, software, and technology
  • You may not copy, modify, reverse engineer, or create derivative works of the platform

7. Data & Privacy

  • We collect and process data in accordance with our Privacy Policy
  • You are responsible for complying with GDPR and UK data protection laws when collecting attendee data
  • You must have appropriate consent to collect and use attendee information
  • We act as a data processor; you are the data controller for your event attendees

8. Prohibited Uses

You agree NOT to:

  • Use the Services for any illegal purpose or in violation of any laws
  • Sell tickets to events that violate laws or regulations
  • Misrepresent event details or engage in fraudulent activity
  • Upload malicious code, viruses, or harmful content
  • Interfere with or disrupt the Services or servers
  • Use the platform to spam or harass others
  • Scrape, data mine, or extract data from the platform without permission
  • Resell or redistribute GoSYNQ services to third parties

9. Limitation of Liability

9.1 Service Availability

  • GoSYNQ provides Services "as is" and "as available"
  • We do not guarantee uninterrupted, error-free, or secure access
  • We are not responsible for issues caused by third-party services (Stripe, Supabase, Resend, etc.)

9.2 Liability Cap

  • To the maximum extent permitted by law, GoSYNQ's total liability for any claims shall not exceed the amount you paid us in the 12 months prior to the claim
  • We are not liable for indirect, incidental, consequential, or punitive damages

9.3 Event Liability

  • You are solely responsible for your events, including safety, permits, insurance, and legal compliance
  • GoSYNQ is not liable for injuries, damages, or losses at your events
  • You agree to indemnify GoSYNQ against claims arising from your events

10. Technical Issues & Scanner Failures

  • We provide technical support during reasonable business hours
  • We are not liable if the ticket scanner malfunctions at an event
  • You are responsible for having backup entry verification procedures
  • We will make reasonable efforts to resolve technical issues promptly

11. Termination

11.1 By You

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of your current billing period
  • No refunds for partial months

11.2 By GoSYNQ

We may suspend or terminate your account for:

  • Violation of these Terms
  • Non-payment
  • Fraudulent or illegal activity
  • Abuse of the platform or staff

We will provide notice where possible, but may terminate immediately for serious violations

11.3 Effect of Termination

  • Upon termination, your access to the Services will cease
  • You may export your data before termination
  • Outstanding fees remain due and payable

12. Modifications to Terms

  • We may update these Terms at any time
  • We will notify you of material changes via email or platform notification
  • Continued use of Services after changes constitutes acceptance
  • If you disagree with changes, you may terminate your account

13. Dispute Resolution

13.1 Governing Law

  • These Terms are governed by the laws of England and Wales
  • Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales

13.2 Informal Resolution

  • Before filing a claim, you agree to contact us to resolve disputes informally
  • We will attempt to resolve disputes in good faith

14. Third-Party Services

GoSYNQ integrates with third-party services including:

  • Stripe (payment processing)
  • Supabase (data storage)
  • Resend (email delivery)
  • Carrd (landing pages)
  • Notion, Airtable, Typeform (integrations)

Your use of these services is subject to their respective terms and privacy policies. GoSYNQ is not responsible for third-party service failures or data breaches.

15. Force Majeure

We are not liable for failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GoSYNQ regarding the Services and supersede all prior agreements.
